REFERRAL PROGRAM  TERMS AND CONDITIONS

I. Introduction

The ELVTR Referral Program (“Program”) is designed to reward existing ELVTR members ("Referrers") and incentivize new participants ("Referees") through a structured rewards system. Participation in this program is subject to the terms and conditions outlined below.

II. Terms for Referrers

Earning Referral Rewards

  • Eligibility: Referrers must be existing ELVTR members with legal residence in the United States, Canada, or the United Kingdom.
  • Reward Criteria: Rewards are earned when a Referee registers for an ELVTR course using the Referrer's unique link, completes their first course, and pays the tuition.

Notification and Nature of Rewards

  • Notification: Referrers are notified via email or their referral program dashboard upon Referee qualification.
  • Reward Type: Rewards are issued as gift cards, as determined by ELVTR.
  • Value: The value is specified at the referral campaign's initiation and may vary based on promotional criteria.

Reward Limitations and Redemption

  • Cap: There may be a maximum number of rewards per Referrer, specified during the campaign.
  • Expiry: Rewards have an expiry date, after which they cannot be redeemed.
  • Redemption Process: Instructions for reward redemption are provided to the Referrer.
  • Adjustment: Rewards may be revoked or adjusted if a Referee cancels enrollment or requests a refund.

Referrer Responsibilities and Sanctions

  • Compliance: Referrers must adhere to promotion rules and avoid misleading practices.
  • Breach of Terms: Violations may lead to disqualification and reward revocation.
  • Unlawful Rewards: ELVTR may seek recovery of deceitfully earned rewards.

III. Terms for Referees

Eligibility and Benefits

  • Eligibility: Open to individuals receiving a referral link from an ELVTR member.
  • Tuition Credit: Referees receive a $200 tuition credit towards any ELVTR course.
  • Redemption: Tuition credit is applied towards course tuition upon successful registration using the referral link.
  • No Obligation: Credit is provided without commitment to purchase.
  • Validity: Credit must be used within 12 months of registration using the referral link.
  • Limitations and Legal Aspects
  • Transferability: The tuition credit is non-transferable and not exchangeable for cash.
  • Limitations: Limited to one tuition credit per person and cannot be combined with other offers.
  • Privacy: Personal information is handled per ELVTR's Privacy Policy.
  • Amendments: ELVTR may modify, suspend, or terminate the program at any time.
  • Fraudulent Activity: Suspected fraud may lead to tuition credit cancellation.
  • Restrictions for Affiliates: Restrictions apply to ELVTR employees, contractors, and affiliates.
  • Compliance: Participants must adhere to applicable laws and regulations.

IV. General Terms Applicable to All Participants

Program Disclaimer

  • Offer State: The program is offered "as is" and "as available", without guarantees.
  • Indemnification: Participants agree to defend, indemnify, and hold ELVTR harmless from claims related to their participation.
  • No Correspondence: Decisions regarding benefits are final; no refunds or exchanges.
  • Governing Law: Governed by the laws of California.

V. Additional Provisions for All Participants

Program Participation and Limitations

  • Enrollment: Referrers are automatically enrolled into the Program and assigned a unique referral link upon filling out an application form for any of the ELVTR courses.
  • Limitation of Liability: ELVTR is not responsible for technical failures or errors impeding participation.
  • Program Changes: ELVTR reserves the right to make changes to the program without prior notice.
  • Participant Conduct: Participants are expected to conduct themselves ethically and in compliance with these terms.

Resolution of Disputes

  • Dispute Resolution: Any disputes arising under these terms will be resolved through binding arbitration in California.
  • Waiver of Class Actions: Participants waive any rights to class actions or class arbitrations.
  • Informal Dispute Resolution: Participants and ELVTR agree to attempt informal resolution before any arbitration.

Intellectual Property and Brand Usage: Use of ELVTR's trademarks or branding must be in compliance with guidelines and not infringe on ELVTR's intellectual property rights.

Confidentiality and Data Protection: Participants must maintain confidentiality of any non-public information acquired through the program.

Data Security: ELVTR commits to protecting personal data in line with its privacy policy and applicable data protection laws.

Termination and Suspension

  • ELVTR's Right: ELVTR may suspend or terminate a participant's involvement in the program for breach of terms or other justifiable reasons.
  • Participant's Right: Participants may choose to exit the program at any time, subject to fulfilling any pending obligations under these terms.

VI. Acknowledgement and Acceptance

By participating in the ELVTR Referral Program, participants acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions. This document represents the entire agreement between ELVTR and the participants regarding the referral program, superseding any prior agreements or understandings.
